  2. END-USER LICENSE AGREEMENT
  3. ===========================================
  4. IP Sentry & IP Recon - c1997 - Rex W. Walker

  6. IMPORTANT READ CAREFULLY:
  7. This End-User License Agreement (EULA) is a legal agreement between you
  8. (either an individual or a single entity) and THE AUTHOR for the software
  9. product identified above, which includes computer software and associated
  10. media and printed materials (if any), and may include online or electronic
  11. documentation (SOFTWARE PRODUCT or SOFTWARE). By installing, copying, or
  12. otherwise using the SOFTWARE PRODUCT, you agree to be bound by the terms
  13. of this EULA. If you do not agree to the terms of this Agreement, you are
  14. not authorized to use the SOFTWARE PRODUCT.
  15.  
  16. Copyright laws and international copyright treaties, as well as other
  17. intellectual property laws and treaties protect the SOFTWARE PRODUCT.
  18. The SOFTWARE PRODUCT is licensed, not sold.
  19.  
  20. GRANT OF LICENSE. This EULA grants you the following rights:

  23. Use and Copy.
  24. THE AUTHOR grants to you the right to use copies of the IPRecon on multiple
  25. machines for the sole and singular purpose of communications with a validly
  26. licensed copy of IPSentry. You may install IPSentry on no more than two
  27. machines per valid license.  The second installation is allowed only if
  28. being used in conjunction with the first copy for redundant monitoring.
  29. The second installed copy of IPSentry must NOT monitor any other machine,
  30. service, or port except for that of the listening port of the first
  31. installation of IPSentry.  You may make other copies of the SOFTWARE
  32. PRODUCT for backup and archival purposes.
  33.  
  34. RESTRICTIONS.
  35.

  37. (Shareware - Unregistered)
  38. Unregistered versions of the SOFTWARE PRODUCT may be used for a period of
  39. not more than 30 days.  After 30 days, you must either stop using the
  40. SOFTWARE PRODUCT, or purchase a validly licensed copy.

  42. You must maintain all copyright notices on all copies of the SOFTWARE
  43. PRODUCT.
  44. --
  45. You may not sell copies of the SOFTWARE PRODUCT to third parties without
  46. express written consent of THE AUTHOR and under THE AUTHOR's instruction.
  47. --
  48. EVALUATION copies may distributed freely without charge so long as the
  49. SOFTWARE PRODUCT remains whole including but not limited to existing
  50. copyright notices, installation and setup utilities, help files,
  51. licensing agreement, run-time libraries, etc. and DOES NOT CONTAIN
  52. either valid serial numbers or illegal serial numbers.  In executing
  53. such an act, or similar copyright or license violation, to the maximum
  54. extent permitted by applicable law you may be held liable for loss of
  55. revenue to THE AUTHOR or THE AUTHOR's representatives due to loss of
  56. sales or devaluation the SOFTWARE PRODUCT or both.
  57.

  59. You may not reverse engineer, decompile, or disassemble the SOFTWARE
  60. PRODUCT, except and only to the extent that such activity is expressly
  61. permitted by applicable law notwithstanding this limitation.

  63. You may not rent or lease the SOFTWARE PRODUCT or the functionality of,
  64. or benefits derived from, the use of the SOFTWARE PRODUCTS.
  65. --
  66. You may permanently transfer all of your rights under this EULA only in
  67. conjunction with a permanent transfer of your validly licensed copy of
  68. the product(s).
  69.

  71. You must comply with all applicable laws regarding the use of the SOFTWARE
  72. PRODUCT.
  73. --
  74. You may not execute this software on more than ONE machine per valid
  75. license except as outlined under GRANT OF LICENSE - use and copy.
  76.  
  77. TERMINATION.
  78. THE AUTHOR may terminate this EULA if you fail to comply with the terms
  79. and conditions of this EULA. In such event, you must destroy all copies
  80. of the SOFTWARE PRODUCT.
  81.  
  82. COPYRIGHT.
  83. All title and copyrights and intellectual property rights in and to the
  84. SOFTWARE PRODUCT and any copies thereof are owned by THE AUTHOR.
  85.  
  86. EXPORT RESTRICTIONS.
  87. You agree that you will not export or re-export the SOFTWARE PRODUCT to
  88. any country, person, entity or end user subject to U.S.A. export
  89. restrictions.  Restricted countries currently include, but are not
  90. necessarily limited to Cuba, Iran, Iraq, Libya, North Korea, Syria,
  91. and the Federal Republic of Yugoslavia (Serbia and Montenegro, U.N.
  92. Protected Areas and areas of Republic of Bosnia and Herzegovina under
  93. the control of Bosnian Serb forces).  You warrant and represent that
  94. neither the U.S.A. Bureau of Export Administration nor any other federal
  95. agency has suspended, revoked or denied your export privileges.

  97. NO WARRANTY.
  98.  
  99. ANY USE OF THE SOFTWARE PRODUCT IS AT YOUR OWN RISK.  TO THE MAXIMUM EXTENT
  100. PERMITTED BY APPLICABLE LAW, THE AUTHOR DISCLAIMS ALL WARRANTIES AND
  101. CONDITIONS, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO,
  102. IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE,
  103. AND NONINFRINGEMENT.

  106. NO LIABILITY FOR CONSEQUENTIAL DAMAGES.

  108. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE
  109. AUTHOR BE LIABLE FOR ANY SPECIAL, INCIDENTAL, INDIRECT, OR CONSEQUENTIAL
  110. DAMAGES WHATSOEVER (INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF
  111. BUSINESS PROFITS, BUSINESS INTERRUPTION, LOSS OF BUSINESS INFORMATION,
  112. OR ANY OTHER PECUNIARY LOSS) ARISING OUT OF THE USE OF OR INABILITY TO
  113. USE THE SOFTWARE PRODUCT, EVEN IF THE AUTHOR HAS BEEN ADVISED OF THE
  114. POSSIBILITY OF SUCH DAMAGES.  BECAUSE SOME STATES AND JURISDICTIONS DO
  115. NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR
  116. INCIDENTAL DAMAGES, THE ABOVE LIMITATION MAY NOT APPLY TO YOU.

  118. LIMITATION OF LIABILITY.

  120. THE AUTHOR'S ENTIRE LIABILITY AND YOUR EXCLUSIVE REMEDY UNDER THIS EULA
  121. SHALL NOT EXCEED FIVE DOLLARS (US$5.00).

  123. MISCELLANEOUS

  125. The laws of the State of Indiana, U.S.A, govern this EULA.
